1. Introduction

Welcome to SunSeed ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered parenting coaching platform, including our website at sunseed.app and all related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and SunSeed.

2. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Service Description

SunSeed provides an AI-powered parenting coaching service that offers guidance based on depth psychology principles, including Jungian theory. Our Service includes:

• AI-generated parenting advice and insights
• Personalized coaching conversations
• Image analysis for behavioral assessment (when provided by user)
• Conversation history and progress tracking

4. Account Registration

To access our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

5. Subscription and Payments

5.1 Pricing

We offer various subscription plans as displayed on our pricing page. All prices are in US Dollars (USD) and are subject to change with notice.

5.2 Billing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fee. Recurring subscriptions will automatically renew unless cancelled before the renewal date.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial subscription periods, except as required by law.

5.4 Refunds

Refund requests may be considered on a case-by-case basis within 7 days of purchase. To request a refund, please contact us at [email protected]. Refunds are processed at our discretion and in accordance with applicable consumer protection laws.

6. User Conduct

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service's functionality
• Use the Service for any commercial purpose without our consent
• Share your account credentials with others
• Upload images of children without appropriate consent
• Use the Service to harm or exploit minors in any way

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by SunSeed or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit through the Service, but grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing the Service to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNSEED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any decisions made based on AI-generated advice
• Unauthorized access to your data
• Service interruptions or errors

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless SunSeed and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

10. International Users

10.1 European Union Users (GDPR)

11. Termination

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. However, if you are a consumer in the EU or Brazil, mandatory consumer protection laws of your jurisdiction may apply.
